Terms & Conditions
To the trade discounts:
When available to the trade will be applied gratis for approved retailers. This is for companies that offer 10-20% trade discounts (ie: Williams-Sonoma, Crate&Barrel, etc.) All payments are due within ten days after receipt of invoice.
Custom & Showrooms:
Furniture, Fabric and other merchandise selections will be invoiced to client at a rate of 20% above manufacturer’s invoice for all items ordered. All orders require payment in full prior to order entry. Unless otherwise specified, shipping, warehousing and installation are additional and will be invoiced under separate cover. Applicable sales tax will apply unless we are provided with a tax-exempt certificate. In the case of items purchased directly by Client, Designer shall invoice Client for the commission only.-
Terms of Purchases:
Client shall assume sole financial responsibility for all orders placed on their behalf and shall at all times be responsible for sales tax, cost of freight, crating, warehousing insurance and delivery.
Client specifically acknowledges that Designer shall not be responsible for delays by failure of others to meet commitments or for any other reason or cause beyond Designer’s control and that Designer shall not be held liable for wearing, fading or any defect of any fabric, material or article purchased on behalf of Client nor for the failure of any goods to comply with samples, displays or catalogues or for any increases in price given by the supplier and that Client’s sole remedy shall be to pursue such defect directly against the supplier and /or manufacturer.
Cancellation of orders is strictly subject to the cancellation policies of the supplier and Designer makes no promises whatsoever with regard thereto. Client indemnifies Designer for any loss, claim, or damage, including reasonable attorney’s fees, resulting from Client’s failure to pay third party suppliers as required.
Designer shall not be responsible for the performance, quality, timely completion, or delivery of any work, materials, or equipment furnished by suppliers, contractors, or consultants or others on the project, or for the cost estimates furnished by any party with respect to the project.
Designer shall also invoice Client for reasonable out-of-pocket expenses in connection with Client’s project, including expenses incurred in traveling on Client’s behalf, blueprint copies, fed-ex expenses.
Photography & Content:
Designer reserves the right to display photography of projects as part of personal portfolio. Client privacy will be handled with care.
There will be times imagery is used that is not the property of bethhersh.com. Best attempt is always made to note the original origins and give credit where it is due. However, if there is ever an image that is incorrectly noted or linked, please email bethhershinteriors@gmail.com and it will be rectified.
If you submit any content to www.bethhersh.com, including comments, you are granting permission to use the submitted content. Designer reserves the rights to copy, distribute, transmit, publicly display, post on social media, reproduce, and reformat submission without compensation. Designer reserves the right to delete any submissions with discretion; www.bethhersh.com has a no-tolerance policy for all spam, derogatory, sexist, racist, and overwhelmingly negative comments. Individuals who submit comments or content in this manner will be automatically deleted and blocked from social networks if applicable.
Termination:
Upon project inception, a customized agreement will be signed which outlines the particulars of the project. This agreement may be terminated by either party immediately upon written notice to the other party. Upon termination of this agreement, Designer shall have no further obligation to provide services to Client; however, Client shall be responsible for its payment obligations related to purchases already ordered on behalf of Client and for any other fees related to services performed by Designer on or before termination.
